DEFAMATION POLICY
Scope
1. This policy covers any content posted on any Coventry University Students’ Union website and/or site related to Coventry University Students’ Union by its students, members of staff or the public which may be considered defamatory.
2. The policy expressed here should be interpreted in a manner compatible with legislation concerning freedom of expression, but readers are reminded that the right to freedom of expression attaches only to lawful conduct. Coventry University Students’ Union expects that contributors to the website/related websites will always exercise the right to freedom of expression with due consideration for the rights of others.
Policy
3. Coventry University Students’ Union deplores all forms of defamatory statements made about its students, staff and any other person. Any defamatory statements made on the Coventry University Students’ Union website/related websites will be regarded as extremely serious. Contributors to the website/related websites are required to comply with the procedures below.
4. Coventry University Students’ Union will not actively monitor content placed on its website/related websites for potentially defamatory material.
5. If material of a defamatory nature comes to its attention, Coventry University Students’ Union can remove this without notice.
6. Any person who believes a statement may be defamatory of them or of others must inform the President at Coventry University Students’ Union as soon as possible in accordance with the procedures set out below. Coventry University Students’ Union will use reasonable endeavours to remove the content as soon as practicable thereafter, pending further investigation.
7. Each complaint made will be considered by Coventry University Students’ Union. If after the investigation, the content is deemed by Coventry University Students’ Union not to be defamatory; it may be re-instated at Coventry University Students’ Union discretion. Coventry University Students’ Union is also empowered to remove potentially defamatory content which comes to his/her attention other than through the complaints procedure.
Complaints procedure
8. Coventry University Students’ Union recognises the sensitive nature of complaints of defamation. No one should be deterred from reporting potentially defamatory statements put on the Coventry University Students’ Union website/related websites which causes them distress because of embarrassment or fear of intimidation or concerns about publicity.
9. Any person who wishes to complain about content placed on the Coventry University Students’ Union website/related websites which may be defamatory of them or of others should contact The President at Coventry University, Priory Street, Coventry, CV1 5FJor alternatively telephone 024 7679 5200 as soon as possible after becoming aware of the potentially defamatory statement.
10. If any person delays in informing Coventry University Students’ Union of the potentially defamatory statement, it is understood that this may increase the damage to their reputation, and the number of people who see the content and may believe the statement is true.
11. Any person offended should make a complaint in writing and, where possible, state:
* the name of the person offended by the content
* the name of the person that posted the content. If this is not known provide any other relevant information
* the precise nature of the offending content e.g. details of the statement made, which website the statement appears on, where the statement features on the website, how the statement is potentially offensive
* date(s) and time(s) when content was posted (if known)
* names of any parties known to have seen the content
* any action already taken by the complainant in relation to the offensive content.
12. Coventry University Students’ Union will remove a statement they consider to be actually or potentially defamatory as soon as practicable and will make such further investigation as is needed to determine (i) whether the statement is or is not defamatory and (ii) whether it should remain removed or may be re-instated on the website.
13. Where it is not possible for the complainant to inform The President of Coventry University Students’ Union in writing, the complainant can inform the President of Coventry University Students’ Union of his or her complaint verbally. However, the complainant must give enough detail for Coventry University Students’ Union to be able to locate and remove the relevant statement. The complainant must then put the complaint in writing as soon as possible.
14. If the complaint is not the person allegedly defamed, Coventry University Students’ Union may at their discretion refrain from removing content unless any such notice is followed up by a complaint directly from the person offended.
15. By Coventry University Students’ Union removing potentially defamatory material from its website/related websites following a complaint, Coventry University Students’ Union makes no comment as to whether or not it considers that material to be actually defamatory.
What is a defamatory statement?
16. A defamatory statement is one which tends to lower the complainant in the estimation of right-thinking members of society generally. A defamatory statement must identify or refer to the complainant and be published by the offender to a third party. This includes written material posted on the University website.
Examples of potentially defamatory statements
17. There is a difference between general abusive and insulting statements and defamatory statements. As such, the use of expletives to describe a person will not necessarily give rise to a claim in defamation.
18. In addition, a potentially defamatory statement need not explicitly refer to a person. Sometimes, it may be obvious who the statement refers to from the context of the content.
19. Some simple examples of defamatory statements are:
“Peter is a liar”
“Jane is racist”
“Jack did not write any of his essays. He copied all of his coursework from a very good internet source”
“Jill has a job which is cash-in-hand and doesn’t pay any tax”
